• i. Your access to or use of or inability to access or use the services
• ii. Any conduct or content of any third party on the services
• iii. Any content obtained from the services
• iv. Unauthorized access, use, or alteration of your transmissions or content

4.3 Consequential Damages Exclusion

In no event shall our aggregate liability exceed the amount you have paid to us in the twelve months preceding the event giving rise to the claim. This limitation applies to all causes of action in the aggregate, including but not limited to breach of contract, breach of warranty, negligence, strict liability, misrepresentations, and other torts.

4.4 Force Majeure Provisions

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Cyprus.

5.2 Dispute Resolution Procedures

In the event of any dispute arising out of or relating to these terms, the parties agree to first attempt to resolve the dispute through good faith negotiations. If the dispute cannot be resolved through negotiations within thirty days, either party may initiate formal dispute resolution proceedings.

Before initiating any formal proceedings, you agree to contact us to attempt an informal resolution. We will make reasonable efforts to work with you to resolve any disputes amicably.

5.3 Severability Clause

If any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of the remaining provisions. The invalid or unenforceable provision shall be replaced with a valid, enforceable provision that most closely matches the intent of the original provision.

These terms supersede all prior or contemporaneous communications, proposals, and agreements, whether electronic, oral, or written, between you and us.
